A BILL TO BE ENTITLED
AN ACT
relating to the establishment of auxiliary county facilities in the unincorporated areas of certain counties. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter B, Chapter 292, Local Government Code, is amended by adding Section 292.030 to read as follows: Sec. 292.030. FACILITIES IN UNINCORPORATED AREA OF CERTAIN COUNTIES. (a) This section applies only to a county that: (1) has a population of more than 350,000; (2) is adjacent to a county with a population of 3.3 million or more; and (3) contains any part of a municipality that is located in three or more counties. (b) The commissioners court of the county may purchase, construct, reconstruct, improve, equip, or provide for by other means, including by lease or lease with an option to purchase, a branch office in the unincorporated area of the county. (c) Any county officer may maintain an office and the county may provide any county service at the branch office authorized by this section. The maintenance of an office or the provision of a service at the branch office must be in addition to an office maintained or service provided at any other location required by law. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
