A BILL TO BE ENTITLED
AN ACT
relating to the applicability of procedures governing restrictive
covenants in certain residential subdivisions.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 201.001(a), Property Code, is amended to
read as follows:
(a) This chapter applies to a residential real estate
subdivision that is located in whole or in part:
(1) within a city that has a population of more than
100,000, or within the extraterritorial jurisdiction of such a
city;
(2) in the unincorporated area of:
(A) a county having a population of 2,400,000 or
more; or
(B) a county having a population of 30,000
[190,000] or more that is adjacent to a county having a population
of 2,400,000 or more; or
(3) in the incorporated area of a county having a
population of 30,000 [190,000] or more that is adjacent to a county
having a population of 2,400,000 or more.
SECTION 2. This Act takes effect September 1, 2005.
