	In SECTION 1 of H.B. 649, proposed Section 222.103, 
Transportation Code, Page 1, Subsection (d) after line 29, add new 
Subsection (3) to read:
		(3)  The Department shall place annually on the 
Internet a letting report by highway district, including all funds, 
and organized by category, including turnpikes, tollways, and 
Regional Mobility Authorities.

A BILL TO BE ENTITLED
AN ACT
relating to the funding of transportation projects by the Texas Department of Transportation. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 222.103, Transportation Code, is amended by amending Subsections (d), (e), and (h) and adding Subsection (d-1) to read as follows: (d) The department annually shall publish [On the request of a member of the legislature, the department shall provide the member] a status report on all highway construction projects, by legislative district, that: (1) are under contract or awaiting funding; and (2) [. The report shall include projects that] would be funded in any manner by [state, federal, or] toll funds. (d-1) On the request of a member of the legislature, the department shall provide the member a status report on all highway construction projects, by legislative district, that: (1) are under contract or awaiting funding; and (2) would be funded in any manner by state, federal, or toll funds. (e) Not [On the request of a member of the legislature, not] later than the 90th day before the date a loan is granted or an expenditure is made by the department for a project under this section, the department shall notify each member of the legislature that represents any part of the area affected by the project of the status of the project and how any other project in any other district would be affected. (h) Money granted by the department each fiscal year under this section may not exceed $1.5 billion [$800 million]. This limitation does not apply to money required to be repaid. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
