A BILL TO BE ENTITLED
AN ACT
relating to prosecution and punishment of certain offenses relating to a driver's license or personal identification certificate. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 521.451, Transportation Code, is amended by amending Subsection (b) and adding Subsection (c) to read as follows: (b) An offense under this section is a Class A [B] misdemeanor. (c) If conduct that constitutes an offense under Subsection (a) also constitutes an offense under Section 106.07, Alcoholic Beverage Code, the actor may be prosecuted only under Section 106.07, Alcoholic Beverage Code. SECTION 2. (a) The change in law made by this Act applies only to an offense committed on or after the effective date of this Act. For the purposes of this section, an offense is committed before the effective date of this Act if any element of the offense occurs before that date. (b) An offense committed before the effective date of this Act is governed by the law in effect when the offense was committed, and the former law is continued in effect for that purpose. SECTION 3. This Act takes effect September 1, 2005.
