A BILL TO BE ENTITLED
AN ACT
relating to fees for registration and inspection of certain fuel
measuring and dispensing devices.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 13.001(a), Agriculture Code, is amended
by adding Subdivision (3) to read as follows:
(3) "Pump" means a gasoline, kerosene, or diesel fuel
measuring or dispensing device.
SECTION 2. The heading to Section 13.1151, Agriculture
Code, is amended to read as follows:
Sec. 13.1151. FEES FOR REGISTRATION AND INSPECTION.
SECTION 3. Section 13.1151(a), Agriculture Code, is amended
to read as follows:
[(a)] The department may charge the owner or operator of a
device a fee, as provided by department rule, to recover the costs
of [for the] registration and inspection of a pump, scale, [or] bulk
or liquefied petroleum gas metering device, or other measuring or
dispensing device required to be registered or inspected under
[Section 13.1011 of] this chapter [code. The department shall
determine the amount of the fee based on the number and the capacity
of the scales, pumps, or metering devices being operated].
SECTION 4. Sections 13.1011(e) and 13.1151(b)-(f),
Agriculture Code, are repealed.
SECTION 5. This Act takes effect September 1, 2005.
