A BILL TO BE ENTITLED
AN ACT
relating to the jurisdiction of the district court and the transfer of cases from the county courts in the 50th Judicial District to the district court. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 24.152, Government Code, is amended by amending Subsection (b) and adding Subsection (d) to read as follows: (b) In addition to other jurisdiction provided by law, the district court in Baylor, Cottle, King, and Knox Counties [counties] has the civil and criminal jurisdiction of a county court. (d) In matters of concurrent jurisdiction, the judge of the county court in Baylor, Cottle, King, or Knox County may transfer a case to the judge of the 50th District Court with the approval of the district judge. When a case is transferred, all processes, writs, bonds, recognizances, or other obligations issued from the transferring court are returnable to the court to which the case is transferred as if originally issued by that court. The obligees in all bonds and recognizances taken in and for a court from which a case is transferred, and all witnesses summoned to appear in a court from which a case is transferred, are required to appear before the court to which a case is transferred as if originally required to appear before the court to which the transfer is made. SECTION 2. This Act takes effect September 1, 2005.
