A BILL TO BE ENTITLED
AN ACT
relating to the dissolution of the Aransas County Conservation and Reclamation District. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. DISTRICT TO BE DISSOLVED. The Aransas County Conservation and Reclamation District, as created by Chapter 337, Acts of the 58th Legislature, Regular Session, 1963, shall be dissolved as provided by this Act. SECTION 2. TRANSFER OF ASSETS. The board of directors of the Aransas County Conservation and Reclamation District shall pay or provide for the payment of any debts or liabilities incurred by the district and transfer all of the district's remaining assets to the City of Rockport: (1) not later than July 1, 2005, if this Act receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution; or (2) not later than October 1, 2005, if this Act does not receive the vote necessary for immediate effect. SECTION 3. DATE OF DISSOLUTION. (a) The Aransas County Conservation and Reclamation District is dissolved on: (1) July 1, 2005, if this Act receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution; or (2) October 1, 2005, if this Act does not receive the vote necessary for immediate effect. (b) Any unsatisfied debt or legally established liability of the district shall be a charge on the assets transferred until paid. SECTION 4. REPEALER. On the dissolution of the district, the following laws are repealed: (1) Chapter 337, Acts of the 58th Legislature, Regular Session, 1963; (2) Chapter 582, Acts of the 62nd Legislature, Regular Session, 1971; and (3) Chapter 271, Acts of the 66th Legislature, Regular Session, 1979. SECTION 5. EFFECTIVE DATE. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
