A BILL TO BE ENTITLED

AN ACT

relating to imposing a fee on a request for a waiver of the waiting 
period following the issuance of a marriage license.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 2.204, Family Code, is amended by adding 
Subsection (d) to read as follows:
	(d)  The clerk of the court shall collect a fee of $25 from an 
applicant who requests a waiver under Subsection (c).  The clerk 
shall remit the fee to the county treasurer, or the person who 
performs the duties of the county treasurer, of the county in which 
the court sits.  The county treasurer, or the person who performs 
the duties of the county treasurer, shall deposit the fees  received 
to the credit of the county general fund to be used for 
court-related purposes for the support of the judiciary.
	SECTION 2.  Section 2.204, Family Code, as amended by this 
Act, applies only to a request for a waiver of the waiting period 
following the issuance of a marriage license that is made on or 
after the effective date of this Act.  A request for a waiver of the 
waiting period that is made before the effective date of this Act is 
governed by the law in effect on the date the request was made, and 
the former law is continued in effect for that purpose.
	SECTION 3.  This Act takes effect September 1, 2005.
