A BILL TO BE ENTITLED
AN ACT
relating to allowing certain early voting polling places to serve
as election day polling places.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 43, Election Code, is
amended by adding Section 43.007 to read as follows:
Sec. 43.007. MAIN POLLING PLACE FOR CERTAIN VOTERS. (a)
This section applies only to an authority that uses an instant
electronic system approved by the secretary of state at each
polling place to verify whether a voter has voted in an election.
(b) The authority conducting an election may establish on
election day an additional polling place at the location of the main
early voting polling place.
(c) A voter may cast a ballot at the additional polling
place established under this section if the voter is unable to find
the polling place in the voter's precinct.
(d) The secretary of state shall adopt rules as necessary to
implement this section.
SECTION 2. This Act applies only to an election ordered on
or after the effective date of this Act.
SECTION 3. This Act takes effect September 1, 2005.
