A BILL TO BE ENTITLED
AN ACT
relating to creating the offense of absconding from parole. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 38, Penal Code, is amended by adding Section 38.061 to read as follows: Section 38.061. ABSCONDING FROM PAROLE. (a) A person released on parole or mandatory supervision under a sentence where the releasee has been convicted of an offense listed under Section 3g(a), Article 42.12, Code of Criminal Procedure, or where there has been an affirmative finding under Section 3g(b) of that article, commits an offense if the releasee becomes an absconder and a warrant for the releasee's return is issued under Section 508.251, Government Code. (b) An offense under this section is a state jail felony. SECTION 2. This Act applies to a releasee who becomes an absconder on or after the effective date of this Act. SECTION 3. This Act takes effect September 1, 2005.
