A BILL TO BE ENTITLED
AN ACT
relating to certain filing requirements for a death certificate.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 193.003(a), Health and Safety Code, is
amended to read as follows:
(a) Not later than the 10th day after the date the person
required to file a death certificate obtains both the personal
information required under Section 193.004 and the medical
certification required under Section 193.005 [of a death that
occurs in this state], a death certificate shall be filed with the
local registrar of the registration district in which:
(1) the death occurs; or
(2) the body is found, if the place of death is not
known.
SECTION 2. Section 193.007(a), Health and Safety Code, is
amended to read as follows:
(a) A death [that occurred more than 10 days but less than
one year before the date of an application for registration of death
may be recorded on a death] certificate not filed within the time
provided by Section 193.003(a) may be [and] submitted for filing
with the local registrar of the registration district in which the
death occurred if an application for registration of the death is
filed before the first anniversary of the date of the death.
SECTION 3. This Act takes effect September 1, 2005.
