A BILL TO BE ENTITLED
AN ACT
relating to benefits payable by the Judicial Retirement System of Texas Plan Two. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Sections 839.102(a) and (c), Government Code, are amended to read as follows: (a) Except as provided by Subsections (b) and (c), the standard service retirement annuity is an amount equal to 50 percent of the state salary, as adjusted from time to time, being paid [at the time the member retires] to a judge of a court of the same classification as the last court to which the retiring member was elected or appointed. (c) The standard service retirement annuity of a person qualifying for retirement under Section 839.101(b) is an amount computed as a percentage of the state salary, as adjusted from time to time, being paid [at the time the member retires] to a judge of a court of the same classification as the last court to which the retiring member was elected or appointed, according to the following schedule: age at retirement percentage of state salary at least 60 but less than 61 40percent at least 61 but less than 62 41.7 percent at least 62 but less than 63 43.6 percent at least 63 but less than 64 45.6 percent at least 64 but less than 65 47.7 percent. SECTION 2. The change in law made by this Act applies only to an annuity payment that becomes due on or after the effective date of this Act. SECTION 3. This Act takes effect September 1, 2005.
