A BILL TO BE ENTITLED

AN ACT

relating to requiring the Texas Department of Transportation to 
include in the statewide transportation improvement program a list 
of transportation projects that the department considers to be 
eligible for tolling or feasible for tolling.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter Z, Chapter 362, Transportation Code, 
is amended by adding Section 362.902 to read as follows:
	Sec. 362.902.  INCLUSION OF TOLL PROJECTS IN STATEWIDE 
TRANSPORTATION IMPROVEMENT PROGRAM. (a) In this section, 
"statewide transportation improvement program" means the 
transportation improvement program for this state as required by 23 
C.F.R. Part 450, Subpart B.
	(b)  For each area of this state included in the statewide 
transportation improvement program, the department shall adopt and 
include in the statewide transportation improvement program a list 
of transportation projects that the department considers to be 
eligible for tolling or feasible for tolling.
	SECTION 2.  This Act takes effect September 1, 2005.
