A BILL TO BE ENTITLED

AN ACT

relating to the availability under the public information law of 
certain documents filed with a county clerk or a district clerk.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 552.117(b), Government Code, is amended 
to read as follows:
	(b)  All documents filed with a county clerk and all 
documents filed with a district clerk are exempt from this section 
if:
		(1)  the documents are not available on the Internet to 
the general public; or
		(2)  before giving access to a document or providing a 
copy of a document, the county clerk or district clerk obtains and 
makes a permanent record of the name, address, and date of birth of 
the person requesting the document.
	SECTION 2.  Section 552.1175(e), Government Code, is amended 
to read as follows:
	(e)  All documents filed with a county clerk and all 
documents filed with a district clerk are exempt from this section 
if:
		(1)  the documents are not available on the Internet to 
the general public; or
		(2)  before giving access to a document or providing a 
copy of a document, the county clerk or district clerk obtains and 
makes a permanent record of the name, address, and date of birth of 
the person requesting the document.
	SECTION 3.  This Act takes effect September 1, 2005.
