A BILL TO BE ENTITLED

AN ACT

relating to the application of the open meetings law and the public 
information law to an independent organization established by a 
power region and certified by the Public Utility Commission.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 39.151, Utilities Code, is amended by 
adding Subsection (n) to read as follows:
	(n)  An independent organization certified under this 
section is subject to Chapters 551 and 552, Government Code, as if 
it were a governmental body under those chapters.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
