A BILL TO BE ENTITLED
AN ACT
relating to the consideration of a person's age in determining the
person's eligibility for a position in a police department in
certain municipalities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 143.023(c), Local Government Code, is
amended to read as follows:
(c) A person who is 45 years of age or older may not be
certified for a beginning position in a police department. [A
person who is 36 years of age or older and under 45 may not be
certified as eligible for a beginning position in a police
department unless the person has at least five years' experience as
a peace officer or at least five years of military experience.]
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
