A BILL TO BE ENTITLED
AN ACT
relating to the consideration of a person's age in determining the
person's eligibility for a position in a fire or police department
in certain municipalities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 143.022(a), Local Government Code, is
amended to read as follows:
(a) The commission shall set the minimum age and physical
requirements for applicants for beginning and promotional
positions in accordance with this chapter. The requirements must
be the same for all applicants.
SECTION 2. Section 143.023(b), Local Government Code, is
amended to read as follows:
(b) Except as provided by Subsection (a) or any other law
that prescribes a minimum age requirement, a [A] person who is
otherwise eligible for a beginning position in a fire or police
department under this chapter may [not] be certified as eligible
for that [a beginning] position regardless of the person's age [in a
fire department if the person is 36 years of age or older].
SECTION 3. Section 143.023(c), Local Government Code, is
repealed.
SECTION 4. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
