A BILL TO BE ENTITLED
AN ACT
relating to the amount spent by a political subdivision on a project supported by bonds approved at an election. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Sections 1251.001-1251.006, Government Code, are designated as Subchapter A, Chapter 1251, Government Code, and a heading for Subchapter A is added to read as follows:
SUBCHAPTER A. BOND ELECTION REQUIREMENTS
SECTION 2. Chapter 1251, Government Code, is amended by adding Subchapter B to read as follows:
SUBCHAPTER B. CONSEQUENCES OF BOND ELECTION
Sec. 1251.052. RESTRICTION ON EXPENDITURES. A county, municipality, or other political subdivision of this state that undertakes a project supported by bonds, the issuance of which is approved at an election, may not spend more on the project than the amount stated in the proposition submitted in the election unless: (1) spending a greater amount on the project is approved by the qualified voters of the political subdivision in a subsequent election, regardless of the source of the additional revenue; or (2) the additional source of revenue for the project is stated in proposition. SECTION 3. The change in law made by Section 1251.052, Government Code, as added by this Act, applies to an expenditure made for a project on or after September 1, 2005, regardless of when the bonds supporting the project were issued or approved. SECTION 4. This Act takes effect September 1, 2005.
