A BILL TO BE ENTITLED
AN ACT
relating to the punishment for the offense of injury to a child.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 22.04, Penal Code, is amended by adding
Subsection (l) to read as follows:
(l) If an offense against a child under this section results
in the death of the child, or if an attempt to commit an offense
against a child under this section is punishable as a felony and
results in the death of the child, the offense or, notwithstanding
Section 15.01, the attempt is punishable by:
(1) imprisonment in the institutional division of the
Texas Department of Criminal Justice for life or for a term of not
more than 99 years or less than 15 years; and
(2) a fine not to exceed $10,000.
SECTION 2. The change in law made by this Act applies only
to an offense committed on or after the effective date of this Act.
An offense committed before the effective date of this Act is
covered by the law in effect when the offense was committed, and the
former law is continued in effect for that purpose. For purposes of
this section, an offense was committed before the effective date of
this Act if any element of the offense was committed before that
date.
SECTION 3. This Act takes effect September 1, 2005.
