A BILL TO BE ENTITLED

AN ACT

relating to driving on a roadway laned for traffic.                           
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 545.060, Transportation Code, is amended 
by amending Subsection (a) and adding Subsection (a-1) to read as 
follows:
	(a)  An operator on a roadway divided into two or more 
clearly marked lanes for traffic[:
		[(1)]  shall drive as nearly as practical entirely 
within a single lane[; and
		[(2)  may not move from the lane unless that movement 
can be made safely].
	(a-1)  An operator on a roadway divided into two or more 
clearly marked lanes for traffic may not move from the lane unless 
that movement can be made safely.
	SECTION 2.  (a)  The change in law made by this Act applies 
only to an offense committed on or after the effective date of this 
Act.  For purposes of this section, an offense is committed before 
the effective date of this Act if any element of the offense occurs 
before that date.
	(b)  An offense committed before the effective date of this 
Act is covered by the law in effect when the offense was committed, 
and the former law is continued in effect for that purpose.
	SECTION 3.  This Act takes effect September 1, 2005.
