A BILL TO BE ENTITLED
AN ACT
relating to the appointment of a voting proxy by a legislative
policy board member of a metropolitan planning organization.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 472.031, Transportation Code, is amended
by adding Subsection (c) to read as follows:
(c) A legislative member of a policy board may only appoint
a proxy under Subsection (a) who is:
(1) the legislative member's employee or staff member;
(2) a person related to the member within the second
degree by consanguinity, as determined under Subchapter B, Chapter
573, Government Code, who is not required to register as a lobbyist
under Chapter 305, Government Code;
(3) another legislative member of the policy board; or
(4) a locally elected official.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
