A BILL TO BE ENTITLED
AN ACT
relating to the manner of administering oaths for certain electronically transmitted documents in justice or municipal court. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Article 45.019(d), Code of Criminal Procedure, is amended to read as follows: (d) A complaint may be sworn to before any officer authorized to administer oaths. The requirement of an oath under this code is satisfied for a complaint or other related document transmitted electronically as permitted by Article 45.012 if: (1) all or part of the document was sworn to; and (2) the electronic form states which parts of the document were sworn to and the name of the officer administering the oath. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
