A BILL TO BE ENTITLED
AN ACT
relating to the application of the Texas Sunset Act to river
authorities and certain other districts.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
ARTICLE 1. AMENDMENTS TO GOVERNMENT CODE
SECTION 1.01. SUNSET ACT. Chapter 325, Government Code, is
amended by adding Sections 325.025 and 325.026 to read as follows:
Sec. 325.025. RIVER AUTHORITIES AND CERTAIN OTHER DISTRICTS
SUBJECT TO REVIEW. (a) A river authority, water authority, or
water district listed in Subsection (c) is subject to review under
this chapter as if it were a state agency but is not abolished under
this chapter.
(b) A river authority, water authority, or water district
listed in Subsection (c) shall be reviewed in accordance with the
schedule under Section 325.026.
(c) This section applies only to:
(1) Angelina and Neches River Authority;
(2) Bexar-Medina-Atascosa Counties Water Control and
Improvement District No. 1;
(3) Brazos River Authority;
(4) Canadian River Municipal Water Authority;
(5) Central Colorado River Authority;
(6) Colorado River Municipal Water District;
(7) Dallas County Utility and Reclamation District;
(8) Guadalupe-Blanco River Authority;
(9) Gulf Coast Water Authority;
(10) Lavaca-Navidad River Authority;
(11) Lower Colorado River Authority;
(12) Lower Neches Valley Authority;
(13) Mackenzie Municipal Water Authority;
(14) North Central Texas Municipal Water Authority;
(15) North Harris County Regional Water Authority;
(16) North Texas Municipal Water District;
(17) Northeast Texas Municipal Water District;
(18) Nueces River Authority;
(19) Palo Duro River Authority of Texas;
(20) Red River Authority of Texas;
(21) Sabine River Authority of Texas;
(22) San Antonio River Authority;
(23) San Jacinto River Authority;
(24) Sulphur River Basin Authority;
(25) Sulphur River Municipal Water District;
(26) Tarrant Regional Water District;
(27) Titus County Fresh Water Supply District No. 1;
(28) Trinity River Authority of Texas;
(29) Upper Colorado River Authority;
(30) Upper Guadalupe River Authority;
(31) Upper Neches River Municipal Water Authority; and
(32) West Central Texas Municipal Water District.
Sec. 325.026. SCHEDULE OF REVIEW FOR RIVER AUTHORITIES AND
CERTAIN OTHER DISTRICTS. (a) The river authorities, water
authorities, and water districts listed in Section 325.025 shall be
reviewed according to the schedule provided by Subsections (b)-(f).
(b) During the periods in which state agencies abolished in
2007 and every 12th year after 2007 are reviewed, the following
authorities shall be reviewed:
(1) Sabine River Authority of Texas;
(2) San Jacinto River Authority;
(3) Trinity River Authority of Texas;
(4) Upper Colorado River Authority; and
(5) Upper Guadalupe River Authority.
(c) During the periods in which state agencies abolished in
2009 and every 12th year after 2009 are reviewed, the following
authorities and districts shall be reviewed:
(1) Angelina and Neches River Authority;
(2) Canadian River Municipal Water Authority;
(3) Central Colorado River Authority;
(4) Colorado River Municipal Water District;
(5) Lavaca-Navidad River Authority;
(6) Mackenzie Municipal Water Authority; and
(7) West Central Texas Municipal Water District.
(d) During the periods in which state agencies abolished in
2011 and every 12th year after 2011 are reviewed, the following
authorities and districts shall be reviewed:
(1) Brazos River Authority;
(2) Dallas County Utility and Reclamation District;
(3) Lower Colorado River Authority;
(4) North Central Texas Municipal Water Authority;
(5) North Texas Municipal Water District;
(6) Northeast Texas Municipal Water District; and
(7) Upper Neches River Municipal Water Authority.
(e) During the periods in which state agencies abolished in
2013 and every 12th year after 2013 are reviewed, the following
authorities and districts shall be reviewed:
(1) Guadalupe-Blanco River Authority;
(2) Gulf Coast Water Authority;
(3) Lower Neches Valley Authority;
(4) North Harris County Regional Water Authority;
(5) Tarrant Regional Water District; and
(6) Titus County Fresh Water Supply District No. 1.
(f) During the periods in which state agencies abolished in
2015 and every 12th year after 2015 are reviewed, the following
authorities and districts shall be reviewed:
(1) Bexar-Medina-Atascosa Counties Water Control and
Improvement District No. 1;
(2) Nueces River Authority;
(3) Palo Duro River Authority of Texas;
(4) Red River Authority of Texas;
(5) San Antonio River Authority;
(6) Sulphur River Basin Authority; and
(7) Sulphur River Municipal Water District.
ARTICLE 2. AMENDMENTS TO LAWS GOVERNING RIVER AUTHORITIES, WATER
AUTHORITIES, AND WATER DISTRICTS
SECTION 2.01. ANGELINA AND NECHES RIVER AUTHORITY.
Subchapter A, Chapter 8501, Special District Local Laws Code, is
amended by adding Section 8501.006 to read as follows:
Sec. 8501.006. APPLICATION OF SUNSET ACT. The authority is
subject to review under Section 325.025, Government Code.
SECTION 2.02. BEXAR-MEDINA-ATASCOSA COUNTIES WATER CONTROL
AND IMPROVEMENT DISTRICT NO. 1. (a) Chapter 605, Acts of the 63rd
Legislature, Regular Session, 1973, is amended by adding Section 1A
to read as follows:
Sec. 1A. The Bexar-Medina-Atascosa Counties Water Control
and Improvement District No. 1 is subject to review under Section
325.025, Government Code.
(b) Chapter 370, Acts of the 73rd Legislature, Regular
Session, 1993, and Chapter 544, Acts of the 74th Legislature,
Regular Session, 1995, are amended by adding Section 1A to read as
follows:
Sec. 1A. APPLICATION OF SUNSET ACT. The district is subject
to review under Section 325.025, Government Code.
SECTION 2.03. BRAZOS RIVER AUTHORITY. Chapter 221, Water
Code, is amended by adding Section 221.0021 to read as follows:
Sec. 221.0021. APPLICATION OF SUNSET ACT. The authority is
subject to review under Section 325.025, Government Code.
SECTION 2.04. CANADIAN RIVER MUNICIPAL WATER AUTHORITY.
Chapter 243, Acts of the 53rd Legislature, Regular Session, 1953,
is amended by adding Section 1A to read as follows:
Sec. 1A. Application of Sunset Act. The District is subject
to review under Section 325.025, Government Code.
SECTION 2.05. CENTRAL COLORADO RIVER AUTHORITY. Chapter
338, Acts of the 44th Legislature, Regular Session, 1935, is
amended by adding Section 1A to read as follows:
Sec. 1A. The District is subject to review under Section
325.025, Government Code.
SECTION 2.06. COLORADO RIVER MUNICIPAL WATER DISTRICT.
Chapter 340, Acts of the 51st Legislature, Regular Session, 1949,
is amended by adding Section 1A to read as follows:
Sec. 1A. The District is subject to review under Section
325.025, Government Code.
SECTION 2.07. DALLAS COUNTY UTILITY AND RECLAMATION
DISTRICT. Chapter 628, Acts of the 68th Legislature, Regular
Session, 1983, is amended by adding Section 1A to read as follows:
Sec. 1A. The district is subject to review under Section
325.025, Government Code.
SECTION 2.08. GUADALUPE-BLANCO RIVER AUTHORITY. Chapter
75, Acts of the 43rd Legislature, 1st Called Session, 1933, is
amended by adding Section 1A to read as follows:
Sec. 1A. The District is subject to review under Section
325.025, Government Code.
SECTION 2.09. GULF COAST WATER AUTHORITY. Chapter 712,
Acts of the 59th Legislature, Regular Session, 1965, is amended by
adding Section 1A to read as follows:
Sec. 1A. The District is subject to review under Section
325.025, Government Code.
SECTION 2.10. LAVACA-NAVIDAD RIVER AUTHORITY. Chapter 186,
Acts of the 50th Legislature, Regular Session, 1947, is amended by
adding Section 1A to read as follows:
Sec. 1A. The District is subject to review under Section
325.025, Government Code.
SECTION 2.11. LOWER COLORADO RIVER AUTHORITY. Chapter 222,
Water Code, is amended by adding Section 222.0021 to read as
follows:
Sec. 222.0021. APPLICATION OF SUNSET ACT. The authority is
subject to review under Section 325.025, Government Code.
SECTION 2.12. LOWER NECHES VALLEY AUTHORITY. Chapter 63,
Acts of the 43rd Legislature, 1st Called Session, 1933, is amended
by adding Section 1A to read as follows:
Sec. 1A. The district is subject to review under Section
325.025, Government Code.
SECTION 2.13. MACKENZIE MUNICIPAL WATER AUTHORITY. Chapter
277, Acts of the 59th Legislature, Regular Session, 1965, is
amended by adding Section 1A to read as follows:
Sec. 1A. The Authority is subject to review under Section
325.025, Government Code.
SECTION 2.14. NORTH CENTRAL TEXAS MUNICIPAL WATER
AUTHORITY. Chapter 86, Acts of the 55th Legislature, Regular
Session, 1957, is amended by adding Section 1A to read as follows:
Sec. 1A. The Authority is subject to review under Section
325.025, Government Code.
SECTION 2.15. NORTH HARRIS COUNTY REGIONAL WATER AUTHORITY.
Chapter 1029, Acts of the 76th Legislature, Regular Session, 1999,
is amended by adding Section 1.011 to read as follows:
Sec. 1.011. APPLICATION OF SUNSET ACT. The authority is
subject to review under Section 325.025, Government Code.
SECTION 2.16. NORTH TEXAS MUNICIPAL WATER DISTRICT. Chapter
62, Acts of the 52nd Legislature, Regular Session, 1951, is amended
by adding Section 1b to read as follows:
Sec. 1b. The District is subject to review under Section
325.025, Government Code.
SECTION 2.17. NORTHEAST TEXAS MUNICIPAL WATER DISTRICT.
Chapter 78, Acts of the 53rd Legislature, Regular Session, 1953, is
amended by adding Section 1A to read as follows:
Sec. 1A. The District is subject to review under Section
325.025, Government Code.
SECTION 2.18. NUECES RIVER AUTHORITY. Chapter 427, Acts of
the 44th Legislature, 1st Called Session, 1935, is amended by
adding Section 1.011 to read as follows:
Sec. 1.011. APPLICATION OF SUNSET ACT. The authority is
subject to review under Section 325.025, Government Code.
SECTION 2.19. PALO DURO RIVER AUTHORITY OF TEXAS. Chapter
438, Acts of the 63rd Legislature, Regular Session, 1973, is
amended by adding Section 1A to read as follows:
Sec. 1A. APPLICATION OF SUNSET ACT. The Authority is
subject to review under Section 325.025, Government Code.
SECTION 2.20. RED RIVER AUTHORITY OF TEXAS. Chapter 279,
Acts of the 56th Legislature, Regular Session, 1959, is amended by
adding Section 1A to read as follows:
Sec. 1A. The Authority is subject to review under Section
325.025, Government Code.
SECTION 2.21. SABINE RIVER AUTHORITY OF TEXAS. Chapter
110, Acts of the 51st Legislature, Regular Session, 1949, is
amended by adding Section 2A to read as follows:
Sec. 2A. The district is subject to review under Section
325.025, Government Code.
SECTION 2.22. SAN ANTONIO RIVER AUTHORITY. Chapter 276,
Acts of the 45th Legislature, Regular Session, 1937, is amended by
adding Section 1A to read as follows:
Sec. 1A. Application of Sunset Act. The District is
subject to review under Section 325.025, Government Code.
SECTION 2.23. SAN JACINTO RIVER AUTHORITY. Chapter 426,
Acts of the 45th Legislature, Regular Session, 1937, is amended by
adding Section 1A to read as follows:
Sec. 1A. The Authority is subject to review under Section
325.025, Government Code.
SECTION 2.24. SULPHUR RIVER BASIN AUTHORITY. Chapter 3,
Acts of the 69th Legislature, 1st Called Session, 1985, is amended
by adding Section 1A to read as follows:
Sec. 1A. APPLICATION OF SUNSET ACT. The authority is
subject to review under Section 325.025, Government Code.
SECTION 2.25. SULPHUR RIVER MUNICIPAL WATER DISTRICT.
Chapter 212, Acts of the 54th Legislature, Regular Session, 1955,
is amended by adding Section 1A to read as follows:
Sec. 1A. The District is subject to review under Section
325.025, Government Code.
SECTION 2.26. TARRANT REGIONAL WATER DISTRICT. Chapter 268,
Acts of the 55th Legislature, Regular Session, 1957, is amended by
adding Section 1A to read as follows:
Sec. 1A. The District is subject to review under Section
325.025, Government Code.
SECTION 2.27. TITUS COUNTY FRESH WATER SUPPLY DISTRICT NO.
1. Chapter 221, Acts of the 60th Legislature, Regular Session,
1967, is amended by adding Section 1A to read as follows:
Sec. 1A. The Titus County Fresh Water Supply District No. 1
is subject to review under Section 325.025, Government Code.
SECTION 2.28. TRINITY RIVER AUTHORITY OF TEXAS. Chapter
518, Acts of the 54th Legislature, Regular Session, 1955, is
amended by adding Section 1A to read as follows:
Sec. 1A. The Authority is subject to review under Section
325.025, Government Code.
SECTION 2.29. UPPER COLORADO RIVER AUTHORITY. Chapter 126,
General Laws, Acts of the 44th Legislature, Regular Session, 1935,
is amended by adding Section 1A to read as follows:
Sec. 1A. The District is subject to review under Section
325.025, Government Code.
SECTION 2.30. UPPER GUADALUPE RIVER AUTHORITY. Chapter 5,
page 1062, Special Laws, Acts of the 46th Legislature, Regular
Session, 1939, is amended by adding Section 1A to read as follows:
Sec. 1A. The District is subject to review under Section
325.025, Government Code.
SECTION 2.31. UPPER NECHES RIVER MUNICIPAL WATER AUTHORITY.
Chapter 412, Acts of the 53rd Legislature, Regular Session, 1953,
is amended by adding Section 1A to read as follows:
Sec. 1A. Application of Sunset Act. The District is subject
to review under Section 325.025, Government Code.
SECTION 2.32. WEST CENTRAL TEXAS MUNICIPAL WATER DISTRICT.
Chapter 66, Acts of the 54th Legislature, Regular Session, 1955, is
amended by adding Section 1A to read as follows:
Sec. 1A. The District is subject to review under Section
325.025, Government Code.
ARTICLE 3. EFFECTIVE DATE
SECTION 3.01. EFFECTIVE DATE. This Act takes effect
September 1, 2005.
