A BILL TO BE ENTITLED

AN ACT

relating to the production or publication of public school 
performance ratings determined under a local accountability 
system.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter C, Chapter 39, Education Code, is 
amended by adding Section 39.056 to read as follows:
	Sec. 39.056.  PRODUCTION OR PUBLICATION OF CERTAIN 
PERFORMANCE RATINGS PROHIBITED. A school district or campus may not 
develop or adopt a local accountability or performance indicator 
system and may not publish or otherwise publicize performance 
ratings other than the ratings assigned to the district or campus 
under this chapter.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
