A BILL TO BE ENTITLED

AN ACT

relating to an offense of using certain portable electronic 
equipment in the front seat of a motor vehicle.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter I, Chapter 545, Transportation Code, 
is amended by adding Section 545.425 to read as follows:
	Sec. 545.425.  USE OF CERTAIN PORTABLE ELECTRONIC EQUIPMENT; 
OFFENSE.  A person who is the operator of a motor vehicle or is 
riding in the front seat of the vehicle may not use the following 
equipment while the vehicle is being operated unless the vehicle is 
stopped:
		(1)  a portable computer;                                              
		(2)  a portable television;                                            
		(3)  a portable digital video disc player; or                          
		(4)  a portable videocassette player.                                  
	SECTION 2.  This Act takes effect September 1, 2005.
