A BILL TO BE ENTITLED

AN ACT

relating to the authority of the Ysleta del Sur Pueblo tribe to 
enter into interlocal contracts.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter B, Chapter 791, Government Code, is 
amended by adding Section 791.0115 to read as follows:
	Sec. 791.0115.  CONTRACTING AUTHORITY OF CERTAIN TRIBES.  
(a)  The Ysleta del Sur Pueblo tribe may contract or agree with a 
local government to perform governmental functions and services in 
the same manner as a local government, except as otherwise provided 
by this section.
	(b)  A party to an interlocal contract entered into under 
this section may contract with a state agency, as that term is 
defined by Section 771.002.
	(c)  Section 791.011(b) does not apply to an interlocal 
contract entered into under this section.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
