A BILL TO BE ENTITLED

AN ACT

relating to requiring the operator of a vehicle storage facility in 
certain counties to accept a personal check or debit card as payment 
for the delivery or storage of a vehicle.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter D, Chapter 2303, Occupations Code, is 
amended by adding Section 2303.158 to read as follows:
	Sec. 2303.158.  PAYMENT BY PERSONAL CHECK OR DEBIT CARD.  (a)  
This section applies only to a vehicle storage facility or a 
governmental vehicle storage facility located in a county with a 
population of 500,000 or more.
	(b)  The operator of a vehicle storage facility shall accept 
a personal check or debit card as payment for any charge associated 
with delivery or storage of a vehicle.
	(c)  In this section, "vehicle storage facility" includes a 
governmental vehicle storage facility as defined by Section 
2303.155.
	SECTION 2.  This Act takes effect September 1, 2005.
