A BILL TO BE ENTITLED
AN ACT
relating to administrative penalties for violations of health and safety provisions relating to retail food service. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 437.002, Health and Safety Code, is amended to read as follows: (a) A county or public health district may enforce state law and rules adopted under state law concerning food service establishments, retail food stores, mobile food units, and roadside food vendors. A county or public health district may enforce state law and rules by imposition of administrative penalties in a manner consistent with Section 437.018 of this Chapter. (b) This chapter does not authorize a county or public health district to adopt orders establishing standards for the operation of food service establishments, retail food stores, mobile food units, or roadside food vendors. SECTION 2. This Act takes effect September 1, 2005.
