A BILL TO BE ENTITLED

AN ACT

relating to funding for the Texas statewide emergency services 
personnel retirement fund.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Chapter 221, Insurance Code, as effective April 
1, 2005, is amended by adding Section 221.008 to read as follows:
	Sec. 221.008.  USE OF CERTAIN TAX.  (a)  The following 
amounts are deposited to the credit of the Texas statewide 
emergency services personnel retirement fund:
		(1)  30 percent of the amount of the annual tax 
collected under this chapter for calendar year 2006 and 
attributable to gross premiums for fire insurance and allied lines; 
and
		(2)  29.1 percent of the amount of the annual tax 
collected under this chapter for calendar year 2007 and 
attributable to gross premiums for fire insurance and allied lines.
	(b)  This section expires December 31, 2008.                            
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
