A BILL TO BE ENTITLED

AN ACT

relating to licensing the disposal of certain low-level radioactive 
wastes. 
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 401.202, Health and Safety Code, is 
amended by adding Subsection (d) to read as follows:
	(d)  Notwithstanding any other provision of this subchapter, 
the commission may license the disposal of low-level radioactive 
waste only if the low-level radioactive waste is generated in a 
state that was an initial party state of the compact under Section 
403.006.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
