A BILL TO BE ENTITLED
AN ACT
relating to excepting certain real property appraisal information from required disclosure under the public information law. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 552.105, Government Code, is amended to read as follows: Sec. 552.105. EXCEPTION: INFORMATION RELATED TO LOCATION OR PRICE OF PROPERTY. (a) Information is excepted from the requirements of Section 552.021 if it is information relating to: (1) the location of real or personal property for a public purpose prior to public announcement of the project; [or] (2) appraisals, including appraisals in a completed report, [or purchase price] of real or personal property that is being acquired for a public purpose or is being sold, prior to the formal action to acquire the property or the formal award of contracts for the property; or (3) the purchase price of real or personal property for a public purpose prior to the formal award of contracts for the property. (b) Section 552.022(a), providing that a category of information listed in that subsection is public information and not excepted from required disclosure under this chapter unless expressly confidential under other law, does not apply to information described by Subsection (a). SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
