A BILL TO BE ENTITLED
AN ACT
relating to the minimum amount of the salaries of county officers or employees. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 152.012, Local Government Code, is amended to read as follows: Sec. 152.012. MINIMUM AMOUNT OF SALARY. The commissioners court may not set the salary of an officer, including an elected officer, or employee at an amount less than the amount of the salary in effect on January 1, 2005 [1972]. The court may not set the salary of a justice of the peace at an amount less than the amount of the salary in effect on May 25, 1973. SECTION 2. The change in law made by this Act applies only to the salary of a county officer or employee in a county fiscal year that begins on or after the effective date of this Act. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
