A BILL TO BE ENTITLED
AN ACT
relating to requiring the use of certain highway toll revenue for certain purposes. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 284.009, Transportation Code, is amended by adding Subsection (j) to read as follows: (j) Toll revenue collected from a conveyed segment of highway under this section may be used only in the county in which the revenue was collected for construction or maintenance of a portion of: (1) the same highway from which the revenue was collected; or (2) a road connecting to that highway. SECTION 2. Section 362.0041(f), Transportation Code, is amended to read as follows: (f) Toll revenue collected under this section: (1) shall be deposited in the state highway fund; (2) may be collected and used by the department only in the county in which the revenue was collected to finance the construction, maintenance, improvement, extension, expansion, or operation of a [the converted] segment of: (A) the same highway from which the toll revenue was collected [and may not be collected except for those purposes]; or (B) a road connecting to that highway; and (3) is exempt from the application of Section 403.095, Government Code. SECTION 3. Sections 284.009(f) and (h), Transportation Code, as added by Chapter 953, Acts of the 78th Legislature, Regular Session, 2003, are repealed. SECTION 4. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
