A BILL TO BE ENTITLED

AN ACT

relating to power of the Texas Commission on Environmental Quality 
to authorize an installment payment schedule for the payment of 
certain administrative penalties.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 7.052(d), Water Code, is amended to read 
as follows:     
	(d)  Except as provided by Subsection (b), each day that a 
continuing violation occurs may be considered a separate violation.  
The commission may authorize an installment payment schedule for an 
administrative penalty assessed under this subchapter, except for 
an administrative penalty assessed under Section 7.057 [or assessed 
after a hearing under Section 7.058].
	SECTION 2.  This Act applies to an administrative penalty 
assessed before, on, or after the effective date of this Act.
	SECTION 3.  This Act takes effect September 1, 2005.
