A BILL TO BE ENTITLED

AN ACT

relating to a lender's refusal to make certain loans secured by real 
property.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter E, Chapter 341, Finance Code, is 
amended by adding Section 341.407 to read as follows:
	Sec. 341.407.  PROHIBITED REFUSAL TO MAKE CERTAIN LOANS 
SECURED BY REAL PROPERTY.  (a)  This section applies only to a 
parcel of real property all or part of which is located in a county 
with a population of less than 7,500.
	(b)  A lender may not refuse to make a loan secured by a 
parcel of property to which this section applies solely because the 
property cannot be accessed from a public road except by traveling 
through one or more other parcels of property not owned by the 
borrower if each owner of each of the other parcels of property 
submits to the lender a statement that the owner agrees to allow 
access to the borrower's property through that owner's property.
	SECTION 2.  This Act takes effect September 1, 2005.
