A BILL TO BE ENTITLED
AN ACT
relating to the imposition of additional requirements on certain persons granted an occupational driver's license. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter L, Chapter 521, Transportation Code, is amended by adding Section 521.2483 to read as follows: Sec. 521.2483. ADDITIONAL ORDER REQUIREMENTS. (a) This section applies only to an order granting an occupational license to a person whose license has been suspended after a conviction under Chapter 49, Penal Code. (b) The order granting the occupational license must: (1) require that the person, before the 15th day after the date the order is signed, submit to the court and the attorney representing the state a written statement, sworn to by the person, that: (A) provides the vehicle identification number of the vehicle to be most regularly driven by the person under the occupational license and the number of the regular license plates most recently issued for that vehicle; and (B) states whether the person is an owner of that vehicle; and (2) provide that if the person is an owner of the vehicle to be most regularly driven under the occupational license, the person is required to: (A) not later than the 15th day after the date the order is signed: (i) surrender the regular license plates issued for that vehicle to the county assessor-collector of the county in which the vehicle is registered; (ii) apply to that county assessor-collector for a set of DWI license plates for the vehicle and pay the required fee for issuance of those license plates; and (iii) affix the DWI license plates to that vehicle; (B) continue to display the DWI license plates on that vehicle until the end of the period of suspension of the person's regular driver's license; and (C) surrender the DWI license plates to the issuing county assessor-collector at the end of the period of suspension and request the county assessor-collector to return the regular license plates that were surrendered by the person to the county assessor-collector. SECTION 2. Subchapter G, Chapter 504, Transportation Code, is amended by adding Section 504.657 to read as follows: Sec. 504.657. DWI LICENSE PLATES. (a) The department shall design DWI license plates for motor vehicles owned by persons who are issued an occupational driver's license under Section 521.248 and required to display the DWI license plates on the vehicle most regularly driven by the person under that occupational driver's license. (b) The license plates shall be distinguishable from any other license plate issued by the department and may have one or more design characteristics that identify the plates as being for a vehicle owned by a person described by Subsection (a). (c) The department by rule shall establish the fee for the issuance of the DWI license plates. The amount of the fee may not exceed the amount that, when added to the other fees collected by the department, is sufficient to recover the actual cost to the department of issuing license plates under this section. SECTION 3. Section 521.2483, Transportation Code, as added by this Act, applies only to an occupational driver's license that is applied for on or after September 1, 2005. SECTION 4. This Act takes effect September 1, 2005.
