A BILL TO BE ENTITLED
AN ACT
relating to training for employees and operators of certain
child-care facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 42.0421, Human Resources Code, is
amended by adding Subsections (e), (f), and (g) to read as follows:
(e) The training required by this section must be provided
by a person who:
(1) is listed on the statewide list of certified
training providers maintained by the Texas Workforce Commission as
certified to provide child-care provider training; or
(2) is an instructor at a public or private
institution of higher education, as defined by Section 61.801,
Education Code, and teaches early child development or another
relevant course, as determined by rules adopted by the executive
commissioner of the Health and Human Services Commission after
considering the topics with respect to which training is required
as provided by 40 T.A.C. Section 746.1309.
(f) An employee or operator of a child-care facility to whom
a training requirement applies under this section may satisfy the
requirement by enrolling in a course taught by an instructor
described by Subsection (e)(2) and attending the course for the
number of hours required by this section.
(g) Notwithstanding Subsections (e) and (f), an employee or
operator of a child-care facility to whom a training requirement
applies under this section may satisfy the requirement through any
means by which the employee or operator was authorized to satisfy
the requirement before September 1, 2005. This subsection expires
September 1, 2007.
SECTION 2. This Act takes effect September 1, 2005.
