A BILL TO BE ENTITLED

AN ACT

relating to a moratorium on the provision of financial assistance 
by the Texas Department of Housing and Community Affairs to certain 
counties or for housing developments in those counties.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter A, Chapter 2306, Government Code, is 
amended by adding Section 2306.009 to read as follows:
	Sec. 2306.009.  MORATORIUM ON DEPARTMENT PROGRAMS IN COUNTY 
WITH POPULATION OF THREE MILLION OR MORE.  (a)  The department may 
not pay or otherwise provide an award of financial assistance under 
this chapter after September 1, 2005:
		(1)  to a county with a population of three million or 
more; or      
		(2)  for purposes of financing a housing development 
located in a county with a population of three million or more.
	(b)  This section expires September 1, 2007.                            
	SECTION 2.  Section 2306.009, Government Code, as added by 
this Act, does not affect a contractual obligation that exists on 
the effective date of this Act.
	SECTION 3.  This Act takes effect September 1, 2005.
