A BILL TO BE ENTITLED
AN ACT
relating to providing a speed limit exception for nurse-midwives
responding to emergencies.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 545.365, Transportation Code, is amended
by amending Subsection (a) and adding Subsection (c) to read as
follows:
(a) The regulation of the speed of a vehicle under this
subchapter does not apply to:
(1) an authorized emergency vehicle responding to a
call;
(2) a police patrol; or
(3) a physician, certified nurse-midwife, or
ambulance responding to an emergency call.
(c) In this section, "certified nurse-midwife" has the
meaning assigned by Section 203.002, Occupations Code.
SECTION 2. (a) This Act does not apply to an offense
committed before the effective date of this Act. For purposes of
this section, an offense is committed before the effective date of
this Act if any element of the offense occurs before that date.
(b) An offense committed before the effective date of this
Act is covered by the law as it existed on the date on which the
offense was committed, and the former law is continued in effect for
that purpose.
SECTION 3. This Act takes effect September 1, 2005.
