A BILL TO BE ENTITLED
AN ACT
relating to public entity qualified health centers located along
the Texas-Mexico border.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 162, Occupations Code is amended by
amending Section 162.001(c) to read as follows:
(c) The board shall certify a health organization to
contract with or employ physicians licensed by the board if the
organization:
(1) is a non profit corporation under the Texas
Non-Profit Corporation Act (Article 1396-1.01 et seq., Vernon's
Texas Civil Statutes) and Section 501 (c)(3), Internal Revenue Code
of 1986 (26 U.S.C. § 501(c)(3)); and or,
(2) is a hospital district that is located in a county
that borders the United Mexican States and is otherwise recognized
by an agency of the federal government as a public entity for
purposes of administering a community health center or a federally
qualified health center; and
(3) [(2)] is organized and operated as:
(A) a migrant, community, or homeless health
center under the authority of and in compliance with 42 U.S.C.
Section 254b or 254c; or
(B) a federally qualified health center under 42
U.S.C. Section 1396(1)(2)(B).
SECTION 5. This Act takes effect September 1, 2005.
