A BILL TO BE ENTITLED

AN ACT

relating to removal or covering of certain signs in a construction 
or maintenance work zone.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter K, Chapter 201, Transportation Code, 
is amended by adding Section 201.907 to read as follows:
	Sec. 201.907.  REMOVING OR COVERING SIGNS IN CONSTRUCTION OR 
MAINTENANCE WORK ZONE.  (a)  In this section, "construction or 
maintenance work zone" has the meaning assigned by Section 472.022.
	(b)  This section applies to a sign that marks an area to 
indicate that the area is a construction or maintenance work zone or 
that restricts the speed limit in a construction or maintenance 
work zone.
	(c)  The department shall remove or cover a sign to which 
this section applies, or require the removal or covering of the 
sign, during any period when:
		(1)  no work is in progress;                                           
		(2)  no hazard exists; and                                             
		(3)  the speed limit is not restricted.                                
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
