A BILL TO BE ENTITLED
AN ACT
relating to the assignment of school nurses at public school campuses. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter A, Chapter 38, Education Code, is amended by adding Section 38.020 to read as follows: Sec. 38.020. NURSE ASSIGNMENT REQUIRED. (a) Each school district that has an enrollment of fewer than 500 students shall assign at least one full-time school nurse to each district campus. (b) Each school district that has an enrollment of at least 500 students shall employ at least one full-time school nurse for each 500 students enrolled in the district. The district shall assign at least one full-time school nurse to each district campus and shall assign any additional school nurses based on the medical needs of students at a particular campus. SECTION 2. This Act applies beginning with the 2005-2006 school year. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
