A BILL TO BE ENTITLED
AN ACT
relating to certificates of public convenience and necessity for
water and sewer utility service.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter G, Chapter 13, Water Code, is
repealed.
SECTION 2. The Texas Commission on Environmental Quality
shall cease issuing and amending certificates of public convenience
and necessity for water utility service and sewer utility service.
SECTION 3. All certificates of public convenience and
necessity for water utility service and for sewer utility service
issued before the effective date of this Act by the Texas Commission
on Environmental Quality or a predecessor agency have no effect as
of the effective date of this Act.
SECTION 4. The holder of a certificate of public
convenience and necessity for water utility service and for sewer
utility service issued before the effective date of this Act by the
Texas Commission on Environmental Quality or a predecessor agency
is not entitled to compensation for the annulment of the
certificate by this Act.
SECTION 5. The Texas Commission on Environmental Quality
shall repeal all of the agency's rules related to certificates of
public convenience and necessity for water utility service and for
sewer utility service as soon as practicable after the effective
date of this Act.
SECTION 6. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
