A BILL TO BE ENTITLED

AN ACT

relating to distribution of condoms in state prisons and jails.               
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter B, Chapter 501, Government Code, is 
amended by adding Section 501.0551 to read as follows:
	Sec. 501.0551.  DISTRIBUTION OF CONDOMS.  The institutional 
division shall make condoms readily available to male inmates in 
facilities operated by or under contract with the department.
	SECTION 2.  Subchapter B, Chapter 507, Government Code, is 
amended by adding Section 507.0231 to read as follows:
	Sec. 507.0231.  DISTRIBUTION OF CONDOMS.  The state jail 
division shall make condoms readily available to male defendants in 
state jail felony facilities.
	SECTION 3.  This Act takes effect September 1, 2005.
