A BILL TO BE ENTITLED
AN ACT
relating to establishing a committee to study the influenza vaccine shortage in this state. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. (a) The Interim Joint Committee on Vaccine Shortages is composed of the number of members determined by the speaker of the house of representatives and the lieutenant governor as follows: (1) members of the house of representatives appointed by the speaker of the house of representatives; and (2) members of the senate appointed by the lieutenant governor. (b) The speaker and lieutenant governor shall jointly select the presiding officer and assistant presiding officer of the committee from among the committee members. The committee may designate other officers as the committee considers appropriate. (c) The committee shall conduct studies and make findings and recommendations the committee considers appropriate regarding issues related to the shortage of the influenza vaccine and other vaccines in this state, including: (1) the impact this state's policies have on the vaccine supply; and (2) any necessary modification of state policies to ensure an adequate supply of all vaccines. (d) The committee may request assistance and information, other than confidential information relating to an identifiable individual, from the Department of State Health Services or any other state agency. The department and each agency shall provide the assistance and information requested. (e) The expenses of the committee, including the compensation of any necessary staff, may be paid from any appropriate funds of the house of representatives, the senate, or a legislative agency. Any member, committee, or agency of the legislature may provide staff support and other resources to the committee. The legislature may appropriate money for the support of the committee. (f) The committee shall file a report of the committee's activities, findings, and recommendations with the governor, the lieutenant governor, and the speaker of the house of representatives not later than December 1, 2006. The report shall include any recommendations for legislative or administrative action the committee considers appropriate. (g) The committee is abolished and this section expires January 1, 2007. SECTION 2. This Act takes effect September 1, 2005.
