A BILL TO BE ENTITLED
AN ACT
relating to the service of alcoholic beverages in a public 
restaurant under a private club registration permit.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Chapter 32, Alcoholic Beverage Code, is amended 
by adding Section 32.031 to read as follows:
	Sec. 32.031.  PRIVATE CLUB IN PUBLIC RESTAURANT.  (a)  In 
this section, "restaurant club" means a private club that has as the 
club's premises an undivided portion of the premises of a public 
restaurant.
	(b)  A group of 10 or more individuals who are residents of 
the county in which the restaurant premises are located may form a 
committee to be designated as the charter members and as the members 
of the alcoholic beverage pool of a restaurant club.  The committee 
may apply for a private club registration permit.
	(c)  The restrictions imposed by Sections 32.03(e), (f), and 
(h) do not apply to a restaurant club.
	(d)  A restaurant club may contract with a qualified 
restaurant entity to manage the club.
	(e)  The bylaws of a restaurant club may provide for the 
waiver of annual meetings and for appointment of club officers by 
the management entity.
	(f)  A restaurant entity contracted to manage a restaurant 
club may:  
		(1)  establish and staff the club membership committee;                
		(2)  purchase and manage the alcoholic beverage pool of 
the club;    
		(3)  establish the price of services provided to the 
club members; and
		(4)  produce club records as required by statute or 
commission rule. 
	SECTION 2.  This Act takes effect September 1, 2005.
