A BILL TO BE ENTITLED
AN ACT
relating to requirements for labeling certain drugs.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter E, Chapter 431, Health and Safety
Code, is amended by adding Section 431.1125 to read as follows:
Sec. 431.1125. OTHER MISBRANDED DRUGS. A drug shall be
deemed misbranded if the following information required on the
label of the drug is not printed in at least 8-point Times New Roman
or Arial font:
(1) the information required by Sections
431.112(e)(2) and (k)(3); and
(2) the information regarding cautionary statements
required by Section 431.113(c)(2).
SECTION 2. This Act takes effect September 1, 2005.
