A BILL TO BE ENTITLED
AN ACT
relating to adjusting the term of an elected officer of a home-rule municipality to comply with the Election Code. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter C, Chapter 26, Local Government Code, is amended by adding Section 26.047 to read as follows: Sec. 26.047. ADJUSTMENT OF TERM FOR COMPLIANCE WITH ELECTION CODE. If under a charter provision the term of an elected office of a municipality begins on a date that would not allow for compliance with all provisions of the Election Code required for holding an election, the governing body of the municipality shall adjust the term of that office to begin on the first date that allows for compliance with those provisions. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
