A BILL TO BE ENTITLED
AN ACT
relating to the creation of a judicial district composed of Fannin
County and to the composition of the 6th and 336th Judicial
Districts.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. The heading to Section 24.106, Government Code,
is amended to read as follows:
Sec. 24.106. 6TH JUDICIAL DISTRICT ([FANNIN,] LAMAR[,] AND
RED RIVER COUNTIES).
SECTION 2. Section 24.106(a), Government Code, is amended
to read as follows:
(a) The 6th Judicial District is composed of [Fannin,]
Lamar[,] and Red River Counties [counties].
SECTION 3. The heading to Section 24.482, Government Code,
is amended to read as follows:
Sec. 24.482. 336TH JUDICIAL DISTRICT ([FANNIN AND] GRAYSON
COUNTY [COUNTIES]).
SECTION 4. Section 24.482(a), Government Code, is amended
to read as follows:
(a) The 336th Judicial District is composed of [Fannin and]
Grayson County [counties].
SECTION 5. Subchapter C, Chapter 24, Government Code, is
amended by adding Section 24.576 to read as follows:
Sec. 24.576. 432ND JUDICIAL DISTRICT (FANNIN COUNTY). The
432nd Judicial District is composed of Fannin County.
SECTION 6. (a) The 432nd Judicial District is created on
the effective date of this Act.
(b) The local administrative district judge shall transfer
all cases from Fannin County that are pending in the 6th District
Court or the 336th District Court on the effective date of this Act
to the 432nd District Court.
(c) When a case is transferred from one court to another as
provided by Subsection (b) of this section, all processes, writs,
bonds, recognizances, or other obligations issued from the
transferring court are returnable to the court to which the case is
transferred, as if originally issued by that court. The obligees in
all bonds and recognizances taken in and for a court from which a
case is transferred, and all witnesses summoned to appear in a court
from which a case is transferred, are required to appear before the
court to which a case is transferred as if originally required to
appear before the court to which the transfer is made.
SECTION 7. This Act takes effect September 1, 2006.
