A BILL TO BE ENTITLED
AN ACT
relating to the designation of a chief plumbing inspector by
populous municipalities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 214.011, Local Government Code, is
amended to read as follows:
Sec. 214.011. PLUMBING INSPECTOR FOR CERTAIN
MUNICIPALITIES. (a) If a municipality with a population of less
than 600,000 does not have a special charter that provides for an
inspector of plumbing, the governing body of the municipality may
appoint an inspector of plumbing for a term fixed by the governing
body.
(b) The same individual may serve as plumbing inspector and
municipal engineer.
SECTION 2. Subchapter B, Chapter 214, Local Government
Code, is amended by adding Section 214.0115 to read as follows:
Sec. 214.0115. CHIEF PLUMBING INSPECTORS FOR POPULOUS
MUNICIPALITIES. (a) A municipality with a population of 600,000 or
more shall designate an individual to serve as chief plumbing
inspector for the municipality for a term fixed by the governing
body of the municipality. The individual designated is not
required to be a municipal employee.
(b) The chief plumbing inspector must:
(1) be a journeyman plumber or master plumber, as
defined by Section 1301.002, Occupations Code; and
(2) meet any additional requirements imposed by the
municipality.
(c) The chief plumbing inspector may hold other related
titles or designations with the municipality such as municipal
engineer or chief mechanical inspector. Another title or
designation does not affect the requirements imposed by Subsection
(b) or the duties imposed on the chief plumbing inspector.
SECTION 3. A chief plumbing inspector designated by a
municipality with a population of 600,000 or more to a term under
Section 214.011, Local Government Code, or under a charter or
ordinance provision may serve as that municipality's chief plumbing
inspector under Section 214.0115, Local Government Code, as added
by this Act, until the earlier of the expiration of the plumbing
inspector's term or September 1, 2007. Section 214.0115, Local
Government Code, as added by this Act, applies to the designation of
a chief plumbing inspector by the municipality on completion of
that plumbing inspector's term or on September 1, 2007, as
appropriate.
SECTION 4. This Act takes effect September 1, 2005.
